The Michigan Department of Transportation has finalized their selections for the Complete Streets Advisory Council and will host their first meeting on Dec 13, 2010 from 1 - 3 pm in the Lake Superior Room within the Historical Center in Lansing. Michigan’s new Complete Streets law, Public Act 134 and 135 of 2010, was cited this week in Opinion No 7251 by Michigan Attorney General Mike Cox. It states that a county road commission does not have to get the permission of a property owner to build a pathway in the easement of a county-built road.
The question dealt specifically with construction of a pedestrian and bicycle pathway in the easement of a county road. “Easements may only be used for lawful purposes,” Mr. Cox said, “but construction of a pedestrian and bicycle pathway in such an easement would constitute a lawful purpose. So, permission of a property owner would not be required to construct such a pathway.”
Governor Granholm held a ceremonial bill signing ceremony for the Complete Streets legislation last Thursday in her ceremonial office in the State Capitol. Numerous Complete Streets Coalition partners, including League of Michigan Bicyclists, Michigan Environmental Council, AARP, Michigan Fitness Foundation, Program to Educate All Cyclists, DD Council, Michigan Trails and Greenways Alliance, Michigan Department of Community Health, American Hearth Association and the Michigan Municipal League were all invited to the ceremony and thanked by the Governor and the legislative sponsors for our involvement.

Both Complete Streets bills (HB 6151 and HB 6152) were presented to Governor Granholm last Thursday afternoon. Late Sunday, she signed them both into law.
They were sent to the Secretary of State’s office on Monday, August 2 as Public Acts 134 and 135 of 2010.
Congratulations to everyone who helped make this possible!
Of course the work is just beginning. These bills really just set the stage for implementing Complete Streets throughout Michigan.
